SMS Terms and Consent Texts

1. Program summary
1.1 Sender: S&P Auto Transportation and Haul LLC ("S&P Auto Transportation"), 5334 Bond St Apt 323, Irving, TX 75038, (726) 348-2000. Messages are sent from a registered U.S. 10DLC number: [+1 (XXX) XXX-XXXX].
1.2 Two separate programs, each with its own consent:
- Account & Load Alerts (transactional/informational): verification results, COI expiry reminders, load request received, counter received, load dispatched, inspection and ePOD reminders, security codes, billing notices.
- Marketing Updates (promotional): new loads on saved lanes, product news, offers.
1.3 Message frequency: Account & Load Alerts vary with your activity (typically 0–10 per week). Marketing Updates: up to [4] per month. Message and data rates may apply. Carriers (T-Mobile, AT&T, Verizon, etc.) are not liable for delayed or undelivered messages.
1.4 Consent to Marketing Updates is never a condition of creating an account, posting, requesting, or purchasing anything.
2. Exact opt-in checkbox texts (unchecked by default; shown at signup and in Account › Notifications)
Checkbox A — Account & Load Alerts
☐ I agree to receive account, verification, and load-related text messages (for example: "request received", "load dispatched", inspection reminders, security codes) from S&P Auto Transportation at the mobile number I provided. Message frequency varies with my activity. Msg & data rates may apply. Reply STOP to cancel, HELP for help. I have read the [SMS Terms] and [Privacy Policy].
Checkbox B — Marketing Updates
☐ I agree to receive recurring marketing text messages (for example: new loads on my lanes, tips, offers) from S&P Auto Transportation at the mobile number I provided, sent using automated technology. Consent is not a condition of purchase or of using the platform. Up to [4] msgs/month. Msg & data rates may apply. Reply STOP to cancel, HELP for help. I have read the [SMS Terms] and [Privacy Policy].
Record for each consent: user ID, phone number, checkbox version, exact text shown, timestamp (UTC), IP address, user agent, and the page URL. Keep for 5 years after the last message.
3. Confirmation (double opt-in) messages
Sent immediately after a box is checked and the phone number is verified:
- Alerts: "S&P Auto Transportation: You're subscribed to Account & Load Alerts. Msg frequency varies. Msg&data rates may apply. Reply HELP for help, STOP to cancel."
- Marketing: "S&P Auto Transportation: You're subscribed to Marketing Updates (up to 4 msgs/mo). Msg&data rates may apply. Reply HELP for help, STOP to cancel."
4. STOP and HELP handling
4.1 Opt-out keywords (case-insensitive): STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, ALTO, CANCELAR, BAJA. On receipt, the number is removed from the program the message came from (and from all programs if the user replies to a marketing message); the opt-out is recorded within seconds, and exactly one confirmation is sent:
"S&P Auto Transportation: You've been unsubscribed and will receive no more texts from this number. Reply START to resubscribe. Help: the contact form at https://spautotransportation.com/contact"
4.2 Help keywords: HELP, INFO, AYUDA. Reply:
"S&P Auto Transportation: Load board alerts. For help email the contact form at https://spautotransportation.com/contact or call (726) 348-2000. Msg&data rates may apply. Reply STOP to cancel."
4.3 Re-subscribe keywords: START, UNSTOP, YES, SI. Re-subscription re-sends the confirmation in Section 3.
4.4 Opt-outs are honored across all channels of that program, in writing or by phone as well, within 10 business days at most (immediately for SMS).
4.5 Marketing Updates are sent only between 9:00 a.m. and 8:00 p.m. in the recipient's local time (inferred from area code or account address), never on federal holidays [attorney: confirm Texas, Florida, Oklahoma quiet-hour rules]. Account & Load Alerts are sent when triggered.

All links use the company domain (no public URL shorteners).

Campaign 1 — Account & Load Alerts

Registered users — FMCSA-registered motor carriers and vehicle shippers — receive verification results, insurance-expiry reminders, load request/counter/dispatch notifications, pickup and delivery inspection reminders, one-time security codes, and billing notices. Campaign 2 — Marketing Updates
- Use case: Marketing.
- Description: "Opt-in promotional messages to registered business users of a vehicle-transport load board: new loads posted on the carrier's saved lanes, product updates and offers. Up to 4 messages per month. Consent is obtained via a separate unchecked checkbox and is not a condition of purchase or use."
- Message flow / opt-in: same as Campaign 1 with Checkbox B text and double opt-in confirmation.
- Sample messages: Section 5, Marketing 1–2.
- Same attribute answers as Campaign 1.
7. Internal rules
7.1 Never send marketing SMS to numbers without a stored Checkbox B consent; never buy or import phone lists; never send cold SMS to FMCSA census contacts (email outreach follows CAN-SPAM instead).
7.2 Every outbound message includes the brand name; every marketing message includes "Reply STOP to opt out".
7.3 Suppress numbers on the opt-out list across all campaigns and re-check before each send; log all inbound keywords.
7.4 Phone numbers are collected only with the user's account; Carriers must confirm that driver numbers they add belong to drivers who have consented (Carrier Agreement §10.3).
